Litigation

Nobody likes to go to court unless they are die-hard litigators or lawyers, as the old saying goes, but real life does create situations where we may end up initiating litigation or become parties in proceedings initiated by someone else. In this regard, we wish to stress that in each and every case we strive to reach an out of court settlement between the parties, whenever possible. If all else fails and we see no possibility for the parties to reach an agreement, only then do we propose to start litigation or court proceedings.

At the same time, you should bear in mind that to reach a successful judicial outcome you will need to rely on a special set of skills and knowledge, encompassing other areas of law – something we firmly believe our members have mastered. We also hope that proceedings launched by electronic means shall bring about faster decision making, saving money and time for our clients.

In this context, we offer legal advice on the following matters:

– Identifying cost-effective forms of litigation for our clients;

– Legal representation in contentious and non-contentious proceedings, in particular lawsuits concerning trademark law, competition law, copyright law, and infringement, compensation or reimbursement of enrichment proceedings;

– Legal representation in court in labour law, real estate law, company law and company law disputes;

– Drafting and submitting payment orders, legal representation in related proceedings;

– Drafting and lodging applications initiating proceedings;

– Drafting and submitting requests to impose provisional measures, legal advice concerning the requirements and deadlines to be met in that regard;

– Legal representation in respect of distraint-description orders;

– Legal advice on charges due in relation to the above.

If you are involved in litigation, in a situation where civil proceedings are imminent or if you are already party to a litigation, please contact: Dr. Tamás M. Kocsis, attorney at law, tamas@drkocsis.hu.
